HAVAK is not for every one. With that in mind, by purchasing HAVAK (previously known as HAVYK) product(s), you hereby acknowledge and agree to the following product disclaimers, terms and conditions of sale as well as any additional information and or warnings that may accompany the product upon shipment and or be updated in the future.
ALL HAVAK DESIGNS ARE MADE TO ORDER IN SMALL BATCHES
HAVAK rarely stocks large volumes of product. As a result, most items are sold as a prepaid "pre-order" item and shipped as soon as production is complete. Order fulfillment typically takes 6~9 weeks but may be longer.
ALL HAVAK EQUIPMENT IS EXTREMELY DANGEROUS.

AVAILABILITY:
HAVAK follows a 'made to order' production schedule. As such, all orders are processed and shipped in the order in which they are received. Our goal is to ship orders as quickly as possible however they are various factors out of our control that may affect this process. As a result, shipping of orders may take ~9 weeks from the date they are received. Once orders have been fulfilled and handed over to their respective courier / transportation companies, tracking information is forwarded to the email associated with the order via the automated system. If you would like additional updates on the status of your order, or would like to request that your order be expedited, please be sure to contact us prior to purchase.

CANCELLATIONS and or RETURNS by CONSUMER:
Orders for inventoried, non-customized products may be cancelled for full refund prior to shipment without penalty. Once orders have been shipped, orders may be returned with seven days (7) of receipt, must be accompanied by a HAVAK issued Return Authorization Number and received by HAVAK in new, resellable condition and in its original packaging prior to any refund of the purchase price, less the outbound shipping charges, less the inbound / return shipping charges and less our standard applicable restocking fee. Customized products are non-refundable. The consumer is responsible for the safe delivery of the returning products to the appropriate shipping provider.
CANCELLATIONS by HAVAK:
Orders, whether for preorder or stock items, are subject to acceptance by and shall only become effective upon shipment by HAVAK. The consumer agrees that HAVAK, in its sole and absolute discretion, may accept or reject any order, in whole or in part, for any reason whatsoever, up to the date of shipment. In the event an order is canceled, rejected or rescinded for any reason, HAVAK agrees to refund the order in full to the original method of payment upon cancellation. The consumer acknowledges and understands that said refund may take a number of business days for the refund transaction to makes its way through the banking system back to the consumer. HAVAK reserves the right to refuse selling any of its products at any time and is under no obligation to disclose said reason(s) whatsoever to the refuse customer.
CHANGES:
HAVAK reserves the right to alter, discontinue, modify and or substitute of equal value any of its product(s) including but not limited to its color, construction, dimensions, features, finishes, materials, measurements, specifications and or pricing without notice. finished product(s) may vary from those shown on this site (as computer renderings are frequently used on this website) and or social media, and they may also differ between production runs.
DAMAGES, IMPERFECTIONS and or OMISSIONS:
The methods in which HAVAK equipment is manufactured and packaged are focused solely on their functionality and not on its appearance.
HAVAK cannot control how shippers, their agents and or employees handle the package once it is out of our possession. As a result, shipping damage may occur that may or may not result in the damage or loss of parts or pieces of the item(s) shipped. In the case of shipping damage in route to the originally noted ship to address, the purchaser is responsible for immediately noting any such issue(s) including providing pictures of any and all damage, contacting HAVAK with those details and possibly filing any associated claim paperwork with said carrier. At that time HAVAK will repair or replace only the damaged components / parts at its sole discretion. HAVAK may also request that the damaged components / parts be packaged and returned to HAVAK or discarded by the customer at no cost.
Although efforts are taken to ensure a 'brand new’ appearance during the product’s manufacturing and shipment, minor imperfection in materials occur. These includes any markings left as the result of the specific fabrication steps (coating, forming, machining, etc) which we choose not cover up or hide. Any claims pertaining to these imperfections must be made immediately upon receipt of the equipment (as all exercise equipment is inherently subject to cosmetic damage over time including but not limited to dents, dings and or scratches as the result of abuse, use and or the environment in which it is used). At that time HAVAK will determine at its solely discretion as to whether or not the item in question will be repaired or replaced.
In the case of missing parts and or pieces, whether the result of a mishandled shipment and or alleged omission, the purchaser is responsible for immediately contacting HAVAK upon receipt of the order to discuss the situation in detail and the proposed remedy which is entirely at HAVAK's sole discretion. HAVAK is not responsible for any shipments in any way whatsoever that are destined beyond the original ship to address and or forwarded to an alternate location (via freight forwarders or other such methods of transportation).
Whether damage, imperfection and or omission, all claims must be accompanied with photographs of the products and the original packaging. Failure to do so immediately terminates any claim of damage or omission
DEMO and or “SALE” ITEMS:
Beta units, demo, “garage sale”, imperfect, mismatched, pre-used, pre-production, prototypes and or ‘scratch + dent’ items become available in limited quantities from time to time, and are sold in “AS IS” condition. They may not be exactly as shown on social media and or the website. They are non-refundable, non-returnable and only available for shipment within the US48. All irregular orders may take 1-2 weeks to ship depending upon order volume and or the need to acquire special packaging materials. Although all attempts are made to insure that our website inventory is kept up to date, purchasing does not guarantee shipment with any demo / garage sale item(s) purchased after all available inventory is sold, will be refunded in full.
DIMENSIONS and SIZES:
All dimensions listed, including product length, width, height and weight are approximate. Due to their unique design, products including weight plates) are typically within 1~2 pounds of their listed / promoted weight (which cannot be more accurate without sacrificing specific design features). Specific to the ADJUSTABLE HAVAKtriads, the listed weight of each component and or plate are rounded (up or down) to the commonly accepted weight increment to make calculating the weight lifted easier on the user.
With regards to apparel items, sizing of HAVAK branded items is specific to each garment’s manufacturer and style. In those instances where the sizing is significantly different than the average, a note will be included in the product description (example: order one size up for looser fit). When in doubt, please contact HAVAK with any sizing questions. Always follow care instructions to avoid changes in fit, durability or sizing
IMPORT DUTY + TAXES:
Any and all importation duties, fees and or applicable taxes imposed as the result of the purchaser’s shipping destination are the responsibility of the purchaser. When completing custom declaration forms, please note that HAVAK equipment is Made in Canada and the USA and uses a USITC Harmonized Tariff Schedule number of 9506.91.00. Important: As HAVAK has no control over shipments once they leave the USA, nor is HAVAK able to intervene in any importation problems which may arise, international orders are placed at your own risk. Failure of the purchaser to pay any and all associated import duties + taxes may result in their country’s custom agency and or the shipper to refuse the release the shipment for delivery, returning the shipment to HAVAK or disposing of the shipment at their discretion. Therefore, it is important for all international purchasers to understand that once the shipment has left HAVAK, they are fully and independently responsible for the handling and payment of any and all associated import costs.
ONE-TIME DISCOUNT CODES:
one-time custom discount codes are not gift cards. they are valid for a specific calendar period and may have a minimum purchase amount to qualify. any attempted use and or misuse of a custom discount code will result in the cancellation of that order, the loss of that custom discount code and or termination of the entire program offer. discount codes are not gift cards, and cannot be exchanged and or redeemed for cash, check or credit of any kind. HAVAK reserves the right to revoke any discount code at any time and at its sole discretion
ORDER FULFILLMENT:
As noted throughout this website, HAVAK follows a 'made-to'order' production schedule and rarely stocks large volumes of product. As a result, it is common for most items to be unavailable for immediate shipment which are then sold as a pre-order item. pre-orders must be paid in full to be added to our fulfillment queue which are then shipped as soon as production of the item(s) is complete. This fulfillment process typically takes ~9 weeks but may take longer.
PRE-ORDERS:
Pre-orders are products ordered and paid for in advance by the customer which may not have yet be manufactured. Typically pre-orders are collected for one calendar month before they are put into production. Please see the AVAILABILITY section above and each product's shop page for additional details.
PRODUCT UPDATES:
HAVAK reserves the right to alter, discontinue and or modify any product(s) including but not limited to its color, construction, dimensions, features, finishes, materials, measurements, specifications and or pricing without notice. Finished product(s) may vary from those shown on HAVAK.net and or social media, and may also differ between productions.
SHIPPING:
All shipments are typically processed without a delivery signature required (unless specifically requested). With the growing number of lost and stolen packages across the country it is recommended that you request that your order is shipped (or redirected) to an address where the package(s) can be securely received. To request a delivery signature for your order, please add this to your 'order notes' in the shopping cart before check out. HAVAK is not responsible for packages that are showing as delivered but otherwise missing or stolen. Any and all shipping discrepancies must be reported to HAVAK within twenty-four hours of delivery
Equipment orders destined within the contiguous United States (US 48) are typically shipped via FedEx Ground or UPS Ground with an average transit time of 5~10 business days. Orders shipping to Alaska and Hawaii may also ship via United States Postal Service with average transit times of 5~10 business days. Orders shipping to US Armed Forces destinations (AA, AE, AP, etc) can only be shipped via USPS. Any and all redelivery, redirect, return, reship and or otherwise undeliverable charges are the sole responsibility of the purchaser. Orders containing different and or multiple items may ship separately. All orders must include a telephone number. Please contact HAVAK as soon as possible if one was not included with your shipping details.

FOR ALL ORDERS OUTSIDE THE US48, please contact HAVAK prior to ordering to confirm shipping costs. Equipment orders destined outside of the USA, may originally ship with either FedEx Ground or the USPS, however, they may be handed over to other regional carriers that can result in uncertain transit times including but not limited to border / custom clearance. Transit times shown above are once they are received by the carries, are only averages and highly dependent upon carrier conditions out of HAVAK’s control (holidays, weather, etc). NOTE: Although carriers may claim “# business days” for delivery of an international shipment, please be aware that we have experienced up to 6~9 weeks due to the number of potential government agencies and transportation companies involved.
UNDELIVERABLE and or MISSING:
In the rare instance that a shipment is lost by the shipper, or the shipment is otherwise “missing or stolen”, the recipient must file the appropriate claim directly with the shipper as soon as possible. any a refund or reshipment will only occur AFTER the shipper has completed their internal investigation confirming the shipment’s status and after HAVAK has been properly reimbursed. Shipments that are returned to HAVAK as non-deliverable (failure to pay import charges, signature unavailable, wrong address, etc) may qualify for a refund of the purchase prior, less a restocking fee, and less the original outbound and any additional inbound / return shipping charges. Shipments that are stolen (prior to or after delivery) and or destroyed or discarded by the shipper due to being undeliverable or failure to pay applicable import duty and or taxes are not the responsibility of HAVAK and do not qualify for any refund.

The USER(s) of this equipment acknowledges that they have read, understand and agree to this warning in its entirety, any and all warnings which may be located on the equipment itself as well as any additional and or updated disclaimers made available on the HAVAK website. The USER hereby CONSENTS to VOLUNTARILY engaging in the use of this equipment and ASSUMES ALL RISK associated with its use and waives any and all claims arising from its fabrication, use, misuse, abuse and or neglect, by themselves or others, including but not limited to damage to the product, surrounding persons and or property, up to and including serious personal injury or death. The owner and or user(s) of this equipment, also agrees that they, their personal representatives, administrators, heirs and assigns, hereby release, discharge and hold harmless HAVAK, its owners, designers, directors, fabricators, representatives and or any associates, from any and all claims or causes of action, known or unknown, for any direct or indirect injury, loss or damage resulting from or arising out of the use, misuse, abuse or neglect of the equipment.
BEFORE EACH USE always confirm that any and all hardware is securely fastened, any and all moving parts are operating properly, that there is no damage to the product, including but not limited to chips, cracks, dents, flaking, leaks, peeling, sharp edges and or tears and that the equipment shows no signs of abuse, misuse or neglect. If there is any loose or missing hardware, any damage and or any of potential problems of any kind DISCONTINUE use immediately and report all findings to the equipment’s owner and or facility management.
ALWAYS USE EXTREME CAUTION when handling and or using this equipment. ALWAYS KEEP fingers, hands, feet and clothing AWAY FROM any and all EDGES, HOLES and MOVINGS PARTS as serious injury may occur. Never drop, hit, throw or strike the equipment or allow any object to make uncontrolled contact with the equipment, including but not limited to another piece of equipment, the floor, hard or sharp objects, personal items and or structures as damage and or injury may result. This equipment may contain lubricated and or moving parts and is designed for use on clean, smooth, hard surfaces such as properly maintained athletic rubber flooring and should never be used on an unclean surface or on any surface which may damage the equipment’s components, finish and or moving parts OR which may possibly become permanently damaged or marked by the use, misuse, abuse, neglect and or lubricant of the equipment. Cleaning, standard maintenance and or lubrication of the equipment’s parts may be required over time dependent upon use and environmental conditions. Equipment should NEVER be affixed to the user. Usage and or storage outdoors or exposing this equipment to uncontrolled environments and temperatures may accelerate corrosion and or material fatigue. ALWAYS USE CAUTION when handling this equipment OUTDOORS as it will become extremely hot to the touch.
HAVAK EQUIPMENT IS DESIGNED TO BE INHERENTLY UNBALANCED, UNSTABLE AND OR OVERSIZED AND IS THEREFORE EXTREMELY DIFFICULT TO CONTROL, HOLD and or LIFT. ALWAYS USE CAUTION AND PROPER TECHNIQUE. CURRENT PRODUCT DESIGNS
CABLE handle and LINK XL
The HAVAK CABLE handle and LINK XL (herein referred to as “ATTACHMENT(S)”) are designed for use with common barbells and belt / cable connected weight stack equipment. Always inspect all equipment before connecting to or otherwise using with these ATTACHMENTS as their condition and or under-maintained state may affect and or otherwise damage the ATTACHMENT or the user. Always use properly designed and rated carabiners / snap clips when connecting the ATTACHMENTS. Always use the ATTACHMENTS in a smooth manner, never in jerking, snapping or yanking type motion. As the ATTACHMENTS are extremely versatile, always ask an experienced or trainer professional before attempting any new usage
HOOK, HOOK XL and LINK
The HAVAK LINK, HOOK and HOOK XL (herein referred to as “PLATES”) are designed to create instability when in use, whether through the own oscillating (aka swinging) movement and or via their adding / connecting of accommodate resistance items (such as bands, chains, etc). The amount of oscillation each PLATE creates is directly related to the amount and direction of movement the barbell experiences, the speed in which the barbell is moving as well as both the weight and PLATE hole selected to connect to the barbell. Due to the number of variable involved in their use, these PLATES are for advanced level users. Always make sure that the PLATES are properly secured to the barbell being used with properly sized collars. These PLATES are not to be considered 'bumper plates' and should not be treated as such. dropping or mishandling of any kind may result in product and or personal / property damages including barbells, equipment, floor, persons, etc.
SCEPTER (previously known as the HAVYKbatt)
The HAVAK SCEPTER (herein referred to as the “SCEPTER”) is designed for use as a both a tool for BodyTempering®️ as well as a strength implement similar to that of a short barbell and or ‘Indian club’. BodyTempering®️ is not chiropractic, massage, occupational therapy, orthopedics, physical therapy, physiotherapy, and or rehabilitation (rehab) in any way. There is no scientific data and or research studies that confirm any claims made by those who have experienced, practice and or utilized BodyTempering®️ principles or similar techniques and or any related equipment. When using the SCEPTER for barbell and or indian club exercises, ALWAYS HANDLE WITH the UTMOST CARE, always use its locking collar, additional collars as needed as well as standard lifting safety precautions. When loading and unloading added resistance, do so in a BALANCED and EVEN manner with the SCEPTER safely on the ground. ALWAYS USE the included collar in addition to properly secured and sized safety clips / collars when using any additional load with the SCEPTER. Never drop the SCEPTER as serious damage to its finish and or structure, as well as any surrounding equipment, flooring, and person(s) and or property may occur.
SLDR (previously known as the HAVAKslider or HAVYKslider)
The HAVAKsldr (herein referred to as “SLDR”) is designed to move omni-directionally (= forwards, backwards, side-to-side and rotate simultaneously) and is therefore inherently and CONSTANTLY UNSTABLE. ALWAYS USE the lower center area as your sole point of contact. NEVER use, stand on, and or apply any pressure on or near the outer edge(s) or plates of the SLDR at any time. The SLDR is designed for use on clean, smooth, hard surfaces and moves in an arcing, curved motion than a perfectly straight line. Always test how the SLDR functions on a discrete portion of the floor before full use, to avoid unwanted damage to and or marking of the floor. Moving the SLDR on a rough, textured and or unclean surface or forcing it to travel in a straight, linear motion may result in an “un-smooth” feel or motion, cause damage to the SLDR and or resulting in the slider tipping over. The SLDR is NOT A SKATING DEVICE and should never be affixed to the user. Never drop the SLDR as serious damage to its finish and or structure, as well as any surrounding equipment, flooring, and person(s) and or property may occur. The SLDR contains multiple moving parts which are pre-lubricated. MAX LOAD per SLDR is 150 LBS.
TRIAD (adjustable, fixed, quick, stealth) and TRIAD XL (previously known as the HAVYKbell, HAVYKgrab and HAVYKtriad)
The HAVAK TRIADs (herein referred to as the “TRIAD”) are designed to allow for both dumbbell and kettlebell usage, however they are not traditional dumbbells or kettlebells. The TRIADs contains multiple peripherally placed handles which dramatically alters the distribution and handling characteristics of the weight. This makes the TRIAD unbalanced and significantly more difficult to control, grip and or handle. The graduated grip sizes also makes handling the TRIAD more difficult than a traditional barbell, dumbbell and or kettlebell. As a result, far less weight is required for an equal or greater training effect. That said, ALWAYS HANDLE WITH the UTMOST CARE and always use the utmost in lifting safety precautions, especially when using the TRIAD for lifting, weighted and or balanced based exercises. Become accustom to the TRIAD’s design and movement before performing any exercise requiring heavier loads, especially those that are overhead, rotational and or swinging in movement and or nature. Whenever adjusting any added weight plates, always place the TRIAD on the ground or a safe, secure and sturdy surface. Always fully secure the required barbell collar or included loading + lockings pins before any and all lifts. Never attempt to adjust or change the load or loosen any collars, loading and or locking pins when in use. Never drop the TRIAD as serious damage to its finish and or structure, as well as any surrounding equipment, flooring, and person(s) and or property may occur.

The method in which HAVAK equipment is produced is focused solely on its functionality and not on its appearance. Coatings are selected based on the desired durability, the intended used and the part’s base material. Areas that are to be gripped / held will typically feature either a knurled or textured powder-coat finish while others areas may be left as raw steel or zinc plated. No finish, whether it be coated, dipped, painted, plated or otherwise, is impervious to damage or deterioration. Therefore the durability of any coating is determined by the amount of care, cleaning, use, mis-use and or environmental exposure it receives.
All reasonable efforts are taken to ensure a quality product appearance HOWEVER minor imperfection in finishing, materials, manufacturing and assembly processes (such as cosmetically inconsistent coatings and or small gaps between mated parts) and or shipping damage may occur. Any claims pertaining to these or any other imperfections must be made immediately upon receipt of the equipment as all exercise equipment is inherently subject to cosmetic damage such as dents, dings, scratches and or general wear as the result of use and the environment in which it is used.

Equipment is warranted against manufacturer’s defect for a period of 30 days. Any and all warranty claims must be made within this period and will be resolved at HAVAK’s sole discretion. HAVAK reserves the right to alter, discontinue or and modify any product design including but not limited to its dimensions, features, finishes, materials, specifications and or pricing without notice or obligation. All colors, dimensions, labels and or other feature and or measurement shown on HAVAK marketing material and or website are approximate and may vary.
HAVAK, its affiliates, associates, directors, designers, owners and or representatives are not certified and or licensed medical care providers and represent that they have no expertise in diagnosing, examining, or treating medical conditions of any kind, or in determining the effect of any exercise equipment on any known or unknown medical condition.
